Terms and conditions
1. Scope
These terms and conditions apply to all orders of TravelSpirit Smart Tags and to the use of the TravelSpirit app, offered by optinno GmbH, Schwarzseestrasse 114, 1716 Schwarzsee. Physical products are currently sold exclusively to customers with a shipping address in Switzerland.
2. Conclusion of contract
The contract is formed by your order in the online shop and its confirmation by optinno GmbH. Order confirmation is sent by email and/or shown in the app.
3. Prices and payment
All prices are in Swiss francs (CHF) including VAT. Available payment methods are the Swiss QR-bill, Bitcoin Lightning, and credit card (via Stripe); TWINT is in preparation.
4. Delivery
Shipping takes place after payment is received. Stated delivery times are non-binding estimates.
5. Right of withdrawal / returns
Unlike the EU, Swiss law does not provide a statutory right of withdrawal for distance-selling contracts. Accordingly, there is generally no right to return goods already ordered unless optinno GmbH expressly grants a voluntary return option.
6. Digital add-on modules
Paid add-on features (e.g. the AI-assisted booking recognition) are unlocked once payment is received. Unless stated otherwise, this is a one-time purchase with no recurring subscription cost.
7. Warranty
The statutory warranty provisions of the Swiss Code of Obligations apply.
8. Liability
To the extent permitted by law, optinno GmbH's liability is limited to intent and gross negligence.
TravelSpirit's finder mechanism is a best-effort service: we provide no guarantee that a lost item will actually be found or returned.
Users are solely responsible for the accuracy and currency of the medical information they store in the Emergency ID feature.
9. Data protection
Information on how we process your data can be found in our privacy policy.
10. Changes to these terms
optinno GmbH reserves the right to amend these terms at any time. The version in force at the time of your order applies.
11. Governing law and jurisdiction
These terms are governed exclusively by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. To the extent permitted by law, the place of jurisdiction is the registered seat of optinno GmbH.
